ABSTRACT
The existing normative acts use such terms as sniper and snipers riwe. However, there is no
specizc provision governing the use of zrearms by a sniper. Before June 5, 2013 it was governed separately – with a general principle ‒ for each individual armed forces formation. Since then, the Act of
24 May 2013 of the measures on direct coercion and zrearms was in acted. It applies to, inter alia, all
entitled to the use of zrearms. xose would be the soldiers serving in the Military Counterintelligence
Service and Military Intelligence Service, and ‒ in principle ‒ Military Police or military law enforcement
authorities. xey have a right to use zrearms in the activities of their institutions on the territory of the
State on the same basis as, for example, a policeman. xis law also applies to duties of a sniper. In times
when this Act was being discussed prior to being passed as a statutory bill, and earlier as well, there
was an obvious problem of the legal assessment of the sniper shooting with intent to kill. Established
Act of 24 May 2013 on measures of force and zrearms usage, certainly does not unequivocally resolve
the problem of admissibility of the action by sniper, or any other authorized personnel, who can have
an order to kill while on duty. At one hand this new law does not allow such move but on the other,
does not prohibit it directly. xe primary purpose of this study is to attempt to resolve this legal clash,
as well as it is an attempt to answer the question of whether opening zre while in sniper duty, a sniper
has to keep in mind all the exact shot procedures dezned in said Act.
