ABSTRACT
On the basis of the Constitution of the Republic of Poland – the President appoints the Supreme Commander of the Armed Forces selected for the duration of war, at the request of the Prime Minister. ve course of modern armed conuict could prevent this appointment. According to author, it is therefore necessary to amend the provision of the Constitution. ve war command system will not work if it is not already implemented. During the war will certainly not be the time to create it from scratch. 1 January 2014 and 30 April 2014 became epective legislative changes called reform of the system of leadership and command of the Polish Armed Forces. vis paper focuses on those standards that apply to the Supreme Commander of the Armed Forces, and shows the uaws of some of the analyzed developments, in particular ambiguity and conuict of laws. Author is presenting a thorough analysis of the problems identited in this study. Some of the described changes to the Supreme Commander of the Armed Forces is moving in the right direction, but the details raise serious doubts. First of all, the point is that the President indicates at the request of the Council of Ministers the day, which begins with a time of war on Polish territory and the same mode of the day, at which time the war ends. vis allows to present a precise and unambiguous detnition of the start and end time of war. Without it one should not be appointed as the Supreme Commander of the Armed Forces. ve same danger arises within political environment in case of possible clash between political institution, if the law is not made clearer. It is particularly dangerous for the defenses of the country.
