The establishment of maritime boundaries is an important issue for the security of a state. Unresolved or unfairly resolved territorial disputes can lead to tensions and conflicts in international relations. One way to delimit maritime areas is to draw the boundary line along the equidistance line. The aim of the publication is to find an answer to the question of whether state security can be – in theory and practice – a factor having a decisive influence on the delimitation process, adjusting the median line accordingly? In response to this research question, the following hypothesis was adopted in this work: state security considerations may theoretically be important when determining maritime borders in the context of assessing the validity of the delimitation line, but in reality this criterion does not play a major role in the delimitation process. The article also aims to draw the reader’s attention to the role of security in the process of maritime delimitation. The basic research methods were qualitative methods present in legal sciences: content analysis and critical assessment. The author focuses primarily on the previous international case law in the discussed area. As a conclusion, it notes that the International Court of Justice has recognized safety-related factors as “relevant” and as potentially influencing the adjustment of equidistance lines, but only in a situation where the delimitation line runs very close to the coast of one country. However, this is only a hypothetical consideration – so far there has not been a single case of taking into account security issues in the delimitation of maritime areas. The analysis of the case law does not indicate what distance this would have to be and in what way the application of the equidistance line would have to threaten the safety of another country. The entire discussion constitutes a starting point for a discussion on the role of the safety factor in the process of delimiting maritime areas.
