ABSTRACT
The aim of this paper is to determine the significance of seabed raw materials as well as to identify possible legal pathways for the International Seabed Authority to restrict deep-sea mining on environmental grounds. The research problem of the paper is framed as a question: Is there a legal basis for far-reaching restrictions on deep-sea mining, and what industrial and technological significance can seabed deposit raw materials possess? The research hypothesis is that the environmental risk posed by deep-sea mining, combined with the environmental mandate of the International Seabed Authority, provides sufficient grounds to restrict such activities, up to and including prohibition. In terms of raw materials, the emphasis was placed on determining the applications of metals found in ocean mineral forms, with particular emphasis on installations of renewable energy sources and electromobility. The article also points to the horizon of the mandate to adopt environmental regulations of the International Seabed Organization in order to indicate the legal basis for regulating the issue of mining as rigorously as possible. Particular attention was paid to the analysis of the possibility of joint operationalization of the precautionary principle together with the seabed principle as the common heritage of humanity. At the same time, the work is characterized by internal institutional difficulties of the Organization, which may translate into further delay in the adoption of appropriate regulations or, in the worst case, lead to paralysis and the lack of an adequate legal framework for conducting deep-sea mining works. The importance of considerations regarding the maximum possible scope of environmental regulations for the issue of raw material security results from the need to take into account potential far-reaching restrictions on deep- -sea mining that may be adopted in the coming years. The essential research method used in the study is a comparative legal analysis of public international environmental law.
